Performance of a contract
We process information when necessary to provide the Services you request, manage your account, synchronize your content, or provide premium features.

Consent
We rely on your consent for optional activities such as microphone access, notifications, certain analytics technologies, and marketing communications.

You may withdraw your consent at any time through the app, your device settings, or by contacting us.

Legitimate interests
We may process limited information when necessary to operate, secure, maintain, and improve the Services, provided those interests are not overridden by your rights.

Legal obligations
We may process or retain information when required to comply with applicable laws, regulations, legal proceedings, or lawful government requests.

Privacy notices should clearly explain the organization collecting data, its purposes, categories of data, legal grounds, retention, recipients, and international transfers where applicable

6. Advertising and Tracking

NexApp does not use your personal sound recordings for advertising.

If advertising is introduced into a version of the Services, this Privacy Policy and the relevant app-store disclosures will be updated to explain:

  • What information is used

  • Whether ads are personalized

  • Which advertising partners are involved

  • What controls are available to you

On Apple platforms, permission is required before tracking users across apps or websites owned by other companies.

7. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy.

Retention periods may depend on:

  • Whether your account remains active

  • The type of information

Account information may be retained while your account remains active.

Personal recordings stored only on your device remain there until you delete them, remove the app, or erase your device data.

We may retain limited records after account deletion when required for legal compliance, fraud prevention, security, transaction records, or dispute resolution.

Information that has been aggregated or anonymized so that it can no longer reasonably identify you may be retained for a longer period.

8. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

These measures may include:

  • Encryption during transmission

  • Access controls

  • Secure hosting

  • Authentication safeguards

  • Monitoring and logging

No method of storage or transmission is completely secure. We cannot guarantee absolute security, but we continually work to protect the information entrusted to us.

9. International Data Transfers

NexApp and its service providers may process information in countries other than the country where you live.

Privacy and data-protection laws in those countries may differ from those in your jurisdiction.

These rights may be subject to legal limitations and verification requirements.

We may need to verify your identity before completing certain requests.

11. Account Deletion

You may delete your NexApp account through the account or privacy settings in the app, where this feature is available.

You may also request deletion by contacting:

privacy@nexapp-sample.com

Deleting your account may permanently remove:

  • Account information

  • Cloud-synchronized preferences

  • Saved playlists and mixes

  • Saved routines

  • Cloud-backed personal recordings

  • Other content associated with your account

Locally stored data may remain on your device until you remove it through the app, clear the app’s storage, or uninstall the app.

Certain information may be retained when required by law or for legitimate security, fraud-prevention, transaction, or dispute-resolution purposes.

12. Marketing Communications

If you choose to receive product news, feature updates, or promotional messages, we may send communications to the email address you provide.

You may unsubscribe at any time by:

  • Using the unsubscribe link in an email

We do not knowingly collect personal information from children without appropriate parental or guardian consent.

If you believe a child has provided personal information to us without proper authorization, contact us at:

privacy@nexapp-sample.com

We will review the request and take appropriate action, including deleting the information where required.

14. Third-Party Links and Services

The Services may include links to third-party websites, app stores, services, or social platforms.

We are not responsible for the privacy practices, security, or content of third parties.

We encourage you to review the privacy policy of each third-party service before providing information or using its features.

15. Permissions Used by the App

NexApp will request permissions only when they are needed. You can manage permissions through your device settings.

Some features may not function when the relevant permission is disabled.

16. Do Not Track and Privacy Controls

Some browsers and devices provide privacy controls such as Do Not Track, tracking-prevention settings, or limits on advertising identifiers.

Because these mechanisms are not implemented consistently across all platforms, our response may vary depending on the technology and applicable legal requirements.

You can use your browser, device, and app privacy settings to manage available controls.

We may update this Privacy Policy from time to time to reflect:

  • Changes to the Services

  • New features

  • Changes in our data practices

  • Legal or regulatory requirements

  • Security or operational improvements

When we make changes, we will update the “Last updated” date at the top of this page.

If changes materially affect your privacy rights, we may provide additional notice through the app, website, email, or another appropriate method.

Your continued use of the Services after an updated Privacy Policy becomes effective means that the updated policy applies to your future use of the Services.
